Terms of Service

"Service" refers to the BotVPS platform, including the website, dashboard, API, and any VPS instances provisioned through it.

"User" or "you" means any individual or entity that creates an account or uses the Service.

"VPS" means a virtual private server provisioned and managed through the Service.

"We", "us", or "BotVPS" refers to BotVPS Inc.

You must be at least 18 years old and capable of entering into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

You are responsible for maintaining the security of your account credentials, SSH keys, and any activity that occurs under your account. We authenticate via magic links and SSH key-only access to VPS instances.

You must provide accurate information when creating your account. We reserve the right to suspend or terminate accounts that contain false or misleading information.

You are responsible for all actions taken through your account, including actions performed by AI agents or automated systems operating on your VPS instances.

You may use the Service for lawful purposes, including running AI agents, development workloads, data processing, and other computing tasks. You agree not to:

• —Use the Service for any illegal activity or to violate any applicable law
• —Send spam, phishing emails, or other unsolicited communications
• —Host or distribute malware, ransomware, or other malicious software
• —Launch denial-of-service attacks or port scans against third parties
• —Mine cryptocurrency without explicit written permission
• —Attempt to gain unauthorized access to other users' instances or our infrastructure
• —Resell or sublicense VPS resources without prior written consent

We reserve the right to suspend or terminate instances that violate this policy, with or without notice depending on severity.

BotVPS is designed for running AI agents and automated workloads. You acknowledge that:

• —You are responsible for the behavior of any AI agent or automated system running on your VPS
• —Agents must comply with the same acceptable use policies as any manual usage
• —You are liable for any damage, data loss, or third-party claims arising from your agents' actions
• —We may throttle or suspend instances exhibiting abusive automated behavior

VPS plans are billed monthly. Payment is processed via Stripe at the time of provisioning. By subscribing to a plan, you authorize recurring monthly charges until you cancel.

You may delete your VPS at any time from the dashboard. Deleting a VPS immediately cancels its associated subscription. Deletion is permanent and takes effect immediately.

All payments are final and non-refundable. We do not offer refunds or credits for partial months, unused time, or downgraded plans. By completing a purchase, you acknowledge this no-refund policy.

We reserve the right to change pricing with 30 days notice. Continued use after a price change constitutes acceptance of the new pricing.

We strive to maintain high availability but do not guarantee uninterrupted service. VPS instances run on third-party infrastructure providers and are subject to their uptime and network conditions.

We are not liable for downtime, data loss, or service interruptions caused by infrastructure provider outages, network issues, scheduled maintenance, or force majeure events.

We will make reasonable efforts to notify you in advance of planned maintenance that may affect your instances.

You retain ownership of all data stored on your VPS instances. We do not access, monitor, or inspect the contents of your instances except as required for service operation or as compelled by law.

You are solely responsible for maintaining backups of your data. VPS deletion is irreversible and all associated data is permanently destroyed.

To the maximum extent permitted by law, BotVPS and its officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

You may close your account and delete your VPS instances at any time via the dashboard. We may terminate or suspend your account if you violate these terms or engage in activity that harms the Service or other users.

Upon termination, your VPS instances will be destroyed and all associated data permanently deleted. Outstanding charges remain payable.

We may update these terms from time to time. Material changes will be communicated via email or a notice on the dashboard. Continued use of the Service after changes take effect constitutes acceptance.

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco, California.
